These Terms and Conditions of Use as set forth herein (hereinafter, “Terms of Use”) constitute an agreement between you and Centro Ararat ., its clinics, and pharmacies (hereinafter,Centro Ararator “CA”). These Terms of Use govern all access to and use of this website, www.CentroArarat.org (hereinafter, the “Website”), and any content, functionality, and services offered through this Website. Therefore, we ask that you read these Terms of Use carefully before using the Website. By using this Website, you accept and agree to be bound by these Terms of Use and our Privacy Policy, as set forth at the following link: www.CentroArarat.org/Politica-De-Privacidad.

2. Changes to the Terms of Use

We reserve the right to modify or update these Terms of Use at any time at our sole discretion. Any modifications will take effect once they are posted on the Website. Your continued use of the Website after such posting constitutes your acceptance of those modifications.

3. Access to the Website

We reserve the right, without prior notice, to remove or modify this Website and any services, materials, or products we provide on the Website. CA may restrict users' access to this Website, either in part or in its entirety.

4. Intellectual Property

The Website, its content, features, and characteristics (including, but not limited to, software, code, databases, content, text, presentation, images, videos, audio, design, layout, and appearance) are the property of Centro Ararat its licensors, and are protected by international, federal, and state intellectual property laws governing copyrights, trademarks, the right of publicity, patents, trade secrets, and any other applicable laws (the “Intellectual Property”).

These Terms of Use allow you to access the Website solely for personal, non-commercial use. Therefore, you may not reproduce, distribute, modify, create derivative works, display, perform, publish, download, store, or transmit the material on the Website.

If you violate these Terms of Use, including the provisions relating to Centro Ararat intellectual property, you will not be entitled to access the Website, and you must destroy any copies or derivative works in your possession. This is in addition to any other remedies available at law.

5. Brands

The name Centro Ararat,” its logos, product or service names, designs, or phrases associated with Centro Ararat trademarks of Centro Ararat (the “Trademark”). You may not use the Trademark without prior written authorization from Centro Ararat. In addition to the Trademark, any other names, logos, product or service names, designs, or phrases on the Website are the trademarks of their respective owners.

6. User Information and Security

You agree that all information you provide as part of your access to, use of, and enjoyment of the Website is subject to our Privacy Policy, available at the following link: www.CentroArarat.org/Politica-De-Privacidad. Centro Ararat use such information in accordance with the provisions of the Privacy Policy.

If you are provided with credential information, such as username, passwords, or any other related information as part of our security measures, you agree to treat this information as confidential, and you will not disclose it to any other person or entity.

You should exercise caution and discretion when accessing the Website from a shared or public computer to prevent third parties from accessing your information. We reserve the right to deactivate your account at any time and at our sole discretion, including, but not limited to, conduct that violates these Terms of Use.

In accordance with Regulation No. 8568 of the Department of Consumer Affairs (DACO) (hereinafter, “DACO Regulation 8568”), Centro Ararat, in its capacity as a Website Operator and an Entity that Collects Personal Information from residents of Puerto Rico, maintains a Privacy Policy that complies with the applicable requirements of said Regulation.

Registration or access to the Website using false identities, fictitious contact information, fraudulent identification information, or any other deceptive means is strictly prohibited. Likewise, it is prohibited to create multiple accounts or profiles for the purpose of circumventing restrictions, bypassing usage limitations, or accessing services or information without authorization. Centro Ararat the right to verify the authenticity of the information provided by users and to cancel or suspend, without prior notice, any account that uses false, impersonated, or fraudulent information.

7. Prohibited Use

You may use the Website only for lawful purposes and in accordance with these Terms of Use. Accordingly, you agree not to use the Website:

  • In violation of any applicable federal, state, local or international law or regulation (including, without limitation, any law relating to the export of data or software to and from the U.S. or other countries).
  • To send, knowingly receive, upload, download, use or reuse any material that does not comply with these Terms of Use.
  • To send or procure the sending of any advertising or promotional material, including any "junk email" or "spam", "chain letter", or any other similar solicitation.
  • To impersonate or attempt to impersonate Centro Ararat, its directors, officers, agents, employees, contractors, other users, or any other person or entity.
  • Sending bulk requests to the Website, including, but not limited to, the repeated or systematic submission of forms, inquiries, or communications in a manner that exceeds reasonable personal use or that may compromise the performance or availability of the Website’s systems.
  • Engaging in any other action or conduct that restricts or inhibits any person's use or enjoyment of the Website, or that, as determined by Centro Ararat, may harm Centro Ararat the users of the Website or expose us to liability.

In addition, you agree not to:

  • Use the Site in any manner that could disable, overburden, damage, or impair the Site or interfere with any other party's use of the Site, including their ability to engage in real time activities through the Site.
  • Use any manual process to monitor or copy any material on the Site or for any other purpose not authorized in these Terms of Use.
  • Use robots, automated scripts, software agents, or any automation tools to interact with the Website, including, but not limited to, automatically filling out forms, simulating user sessions, or any programmatic access that has not been expressly authorized in writing by Centro Ararat.
  • Use any device, software or routine that interferes with the proper functioning of the Website.
  • Introduce viruses (including, "Trojan horses" and "worms"), logic bombs, or other malicious or technologically harmful material.
  • Attempt to gain unauthorized access to, interfere with, damage or disrupt any part of the Web Site, the server on which the Web Site is stored or any server, computer or database connected to the Web Site.
  • Attacking the Web Page through a denial-of-service attack or a distributed denial-of-service attack.
  • Attempt to interfere with the proper functioning of the Website.

7.1 Prohibition on Scraping, Harvesting, Automated Extraction, and Commercial Exploitation

The following is expressly prohibited:

  • Use bots, spiders, scrapers, crawlers, harvesters, or any automated extraction technology to access, collect, copy, monitor, or extract content, data, contact information, or any other information available on the Website.
  • Engaging in scraping, data harvesting, data mining, or the systematic extraction of content from the Website, whether for personal, commercial, or profit-making purposes.
  • Use information obtained through automated extraction for advertising, commercial, or marketing purposes, or for any other unauthorized use.
  • Copying, storing, or reusing content from the Website using automated or semi-automated processes.

Legal Notice: To the extent that any data regarding CA employees or staff is obtained through automated extraction from the Health Care Provider’s digital assets, such action may constitute unauthorized commercial use and could give rise to claims under Puerto Rican laws regarding the misuse of personal or commercial information.

Furthermore, Centro Ararat the right to implement reasonable technical measures, including, but not limited to, access restrictions, rate limiting, and/or CAPTCHAs, to prevent unauthorized use.

 

7.2 Technical Security Measures

Centro Ararat technological security measures designed to protect the integrity, availability, and confidentiality of the Website and its systems. These measures include, but are not limited to: (i) authentication and access control systems to prevent unauthorized access; (ii) mechanisms for detecting and blocking bots, including CAPTCHAs and human behavior verification; (iii) rate limiting to prevent abuse of forms and interactive features; (iv) blocking IP addresses and network ranges associated with malicious or suspicious activity; and (v) continuous monitoring of access and usage patterns to detect anomalous behavior.

It is expressly prohibited to circumvent, disable, or otherwise alter the technological security and accesscontrol measures implemented by Centro Ararat. Any attempt tocircumvent such measures may constitute a violation of these Terms of Use, the Digital Millennium Copyright Act ( 17 U.S.C. § 1201), the Computer Fraud and Abuse Act (18 U.S.C. § 1030), and any other applicable federal or state law, with the corresponding legal consequences, including civil and/or criminal action.

 

8. User Contributions

The Website may contain material or information contributed by users through interactive features (hereinafter, “User Contribution” or “User Contributions”). All User Contributions must comply with the standards set forth in these Terms of Use. Any User Contribution posted on this Website shall be deemed non-confidential and non-proprietary. By posting any User Contribution on the Website, you grant and assign to Centro Ararat right to use, reproduce, modify, perform, publish, distribute, and disclose to third parties any material or information deemed to be a User Contribution.

You represent and warrant that:

  • All of your user contributions comply and will comply with these Terms of Use.
  • You understand and agree that you are responsible for any User Contributions you submit or contribute, and that you—and not Centro Ararat—are solely responsible for such content, including its legality, reliability, accuracy, and appropriateness.
  • We are not liable to third parties for the content or accuracy of User Contributions posted on the Website.

9. Monitoring and Implementation

Centro Ararat the right to:

  • To remove or reject the publication of any User Contribution for any reason or for no reason at all, at our sole discretion.
  • To take any action with respect to any User Contribution that we deem necessary or appropriate in our sole discretion, including if we believe that such User Contribution violates these Terms of Use, such as by infringing any intellectual property rights or other rights of any person or entity, threatening the personal safety of users of the Website or the public, or potentially creating liability for Centro Ararat.
  • Disclose your identity or other information about you to any third party who claims that material posted by you violates their rights, including their intellectual property rights or their right to privacy.
  • Take appropriate legal action, including, without limitation, notifying law enforcement officials of any illegal or unauthorized use of the Site.
  • To terminate or suspend your access to all or part of the Website for any violation of these Terms of Use, or for any reason that Centro Ararat appropriate in its sole discretion.
  • Without limiting the foregoing, Centro Ararat the right to cooperate fully with any law enforcement authority that requests or orders us to disclose the identity or other information of any person who posts any material.

YOU RELEASE CENTRO ARARAT FROM LIABILITY CENTRO ARARAT ANY CLAIM ARISING FROM ANY ACTION TAKEN BY CENTRO ARARAT , OR AS A RESULT OF, INVESTIGATIONS CONDUCTED BY CENTRO ARARAT LAW ENFORCEMENT AUTHORITIES.

10. Content Standard

This content standard applies to any and all User Contributions and use of the Site. Each User Contribution must fully comply with all applicable federal, state, local and international laws and regulations.

Without limiting the foregoing, User Contributions shall not:

  • Include any material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory or objectionable.
  • Promote sexually explicit or pornographic material, violence or discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.
  • Infringe any patent, trademark, trade secret, copyright, right to one's own image, or other intellectual property or other rights of any other person.
  • Violate the legal rights (including rights of publicity and privacy) of others or include any material that could give rise to any civil or criminal liability under applicable laws or regulations or that otherwise may be in conflict with these Terms of Use and our Privacy Policy, www.CentroArarat.org/Politica-De-Privacidad.
  • Cheating people.
  • Promote illegal activities, or promote, or assist in promoting any illegal act.
  • Causing, actually or probably, discomfort, inconvenience, unnecessary anxiety, or embarrassment.
  • Impersonating another person, or misrepresenting your identity or affiliation with any person or organization.
  • Involve commercial activities or sales, such as contests, sweepstakes and other sales, barter or advertising promotions.
  • To give the impression that they originate from or are endorsed by Centro Ararat any other person or entity, when this is not the case.

11. Intellectual Property Policy on Infringement (DMCA)

If you, as the owner, licensee, or agent, believe that someone has infringed your copyright on this Web Site, please contact quejas@centroararat.org with our Authorized Agent by following the steps below:

The Notice must comply with the requirements set forth in the Digital Millennium Copyright Act (hereinafter “DMCA”), as codified in 17 U.S.C. § 512(c)(3), which can be found at http://www.copyright.gov/title17/. You are responsible for ensuring that the notice complies with the requirements set forth by the DMCA, as amended and interpreted by the competent courts, and should not rely solely on the information provided here.

The notification must include the following:

  1. Identify the copyrighted work or expression that you claim has been infringed, or, if the notification covers multiple copyrighted works, you may provide a representative list of the copyrighted works that you claim have been infringed.
  2. Identify the material or link that you claim is infringing (or the subject of infringing activity) and to which access should be disabled, including, at a minimum, the URL of the link displayed on the website where such material can be found.
  3. Please provide your mailing address, telephone number and e-mail address.
  4. Include both of the following statements in the body of the Notice:
    1. “I hereby declare that I believe in good faith that the use of the work or expression infringes my copyright, as it is not authorized by the copyright owner, the copyright owner’s agent, or the law.”
    2. “I hereby declare under penalty of perjury that the information in this Notice is accurate and that I am the owner, or am authorized to act on behalf of the owner, of the copyrighted work or expression, or of an exclusive right under copyright that I claim is being infringed.”
  5. Please provide your full legal name and your electronic or physical signature.

Counter-Notification

A person who has been notified of an infringement under these Terms of Use may also file a counter-notification in accordance with Sections 512(g)(2) and 512(g)(3) of the DMCA. If we receive a counter-notification, we may restore the material in question. To submit a counter-notification, you must send the following form to our Designated Agent, following the procedures and formalities detailed in Section 512(g)(3) of the DMCA, which can be found at http://www.copyright.gov/title17/.

Thus, for example—without excusing you from directly reviewing Section 512(g)(3) of the DMCA—the counter-notification shall include the following:

  1. Identification of the material that has been removed or to which access has been disabled on the Site and the location where the material appeared before it was removed or access was disabled.
  2. A statement such as the following: “I hereby declare, under penalty of perjury, that I believe in good faith that the material was removed or disabled as a result of an error or misidentification of the material that was to be removed or disabled.”
  3. Your name, address, phone number, and email address.
  4. Include the following statement in the body of the notice:
    1. “I hereby consent to the jurisdiction of the Court of Puerto Rico or, if my address is outside Puerto Rico, the U.S. District Court for the District of Puerto Rico, and I waive service of process by the person who notified Centro Ararat the copyright infringement.”
  5. Please provide your full legal name and your electronic or physical signature.

If we receive a counter-notification, Centro Ararat send a copy of it to the original complainant, informing that person that they may replace the removed content or restore access to it within 10 calendar days. Unless the copyright owner files a lawsuit seeking a court order against the user who provided the content, the removed content may be replaced, or access to it may be restored, within 10 to 14 calendar days or more after we receive the counter-notification.

12. Notice of Trademark Infringement

If you believe that a user is using your mark in a way that constitutes trademark infringement, you should provide our Authorized Agent with the following information:

  1. Your physical or electronic signature, or a physical or electronic signature of a person authorized to act on your behalf;
  2. Information reasonably sufficient to permit us to contact you or your authorized agent, including name, address, telephone number, and e-mail address;
  3. Identification of the mark(s) you claim have been infringed, including (i) for registered marks, a copy of each relevant federal or state trademark registration certificate or (ii) for marks by use only, evidence sufficient to establish the time, period, and geographic area in which you have used the infringing mark;
  4. A statement that you have not authorized the challenged use and that you have a good faith belief that the challenged use is not authorized by law.

Upon receiving a notification that complies with the foregoing, Centro Ararat whether the infringing trademark is present on the Website, notify the user who posted the infringing trademark, and take the measures it deems appropriate, in its sole discretion, including the removal of the infringing trademark from the Website.

A user may respond to the takedown notice by demonstrating that (a) the Infringed Trademark has been canceled, expired, or lapsed, or (b) the user holds a trademark registration, a valid license protecting the trademark, or some other relevant right to the trademark alleged to have been infringed. If the user is able to demonstrate (a) or (b), the Company may decide not to remove or to restore the content that allegedly infringes the trademark. Centro Ararat to comply with a takedown request, it will do so within a reasonable time after receiving the notice.

However, Centro Ararat with the terms of any court order related to the alleged trademark infringement on the Website.

13. Rights to One's Own Image

We respect the self-image rights of each of our users. If you believe that someone has violated your self-image rights as a result of User Contributions on the Site, please provide our Authorized Agent at quejas@centroararat.org with the following information:

  1. Information reasonably sufficient to permit us to identify the content or material containing your image;
  2. Your name, address, telephone number and e-mail address;
  3. A statement that you, or in the case of a minor, your parent or legal guardian, have not authorized the disputed use, and that the use is not authorized by law; and
  4. A statement under penalty of perjury that the information in the notice is accurate and that you are the entitled party, or that you are the legal representative of the party whose rights are affected.

Upon receiving a notification that complies with the foregoing, Centro Ararat the measures it deems appropriate, including the removal of the content or material in which the disputed use of the Website occurs, and will notify the user in question, unless, prior to such removal, the user in question demonstrates that he or she has the appropriate authorization or consent to use his or her image.

However, Centro Ararat with the terms of any court order relating to the conduct of the party named in that court order.

14.1 Notice Regarding Medical Information

The content available on the Website is for informational and educational purposes only. Nothing on the Website constitutes medical advice, diagnosis, or treatment. The information provided is not a substitute for consultation with a duly licensed healthcare professional.

This website should not be used for emergency communications. If you believe you are experiencing a medical emergency, you should immediately call 911 or go to the nearest medical center and/or emergency room.

15. Information About You and Your Visits to the Website

All information collected through the Website is governed by our Privacy Policy, available at: www.CentroArarat.org/Politica-De-Privacidad. By using the Website, you agree to all actions we take regarding your information in accordance with the Privacy Policy.

In accordance with Article 6(b)(6) of DACO Regulation 8568, Centro Ararat that the Website does not currently respond to “Do Not Track” (DNT) signals sent by web browsers. The use of browser tools or extensions that send such signals will not prevent the collection of technical information described in the Privacy Policy. Centro Ararat to monitor legal and technological developments related to DNT signals and will update this disclosure accordingly.

In accordance with Article 6(b)(7) of DACO Regulation 8568, Centro Ararat that third parties, including providers of web analytics tools and tracking platforms, may collect personal information about your online activities across various websites, including this Website. Centro Ararat control the data collection practices of such third parties. For more information about these third parties and their privacy practices, please see our Privacy Policy.

You may link to the Site provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. However, you must not create a link that suggests any form of association, approval, or sponsorship on our part without our express written consent.

If the Website includes links to other websites and resources provided by third parties, these links are provided solely for your convenience. This includes links to access your “My Health” electronic medical record (Patient Portal). Centro Ararat control and is not responsible for the content, policies, or practices of third-party sites.

The owner of this Website is based in Puerto Rico. We offer this Website for the exclusive use of individuals located in Puerto Rico. We make no representation that the Website or any of its content is accessible or appropriate outside of Puerto Rico. Access to the Website may not be legal for certain individuals or in certain countries. If you access the Website from outside Puerto Rico, you do so at your own risk and are responsible for complying with local laws.

22. Governing Law and Jurisdiction

All matters relating to the Web Site and these Terms of Use and any dispute or claim arising therefrom or related thereto shall be governed by and construed in accordance with the laws of Puerto Rico and applicable federal law.

Any legal claim, action or proceeding arising out of or related to these Terms of Use or the Website shall be brought exclusively in the state courts of Puerto Rico. You hereby waive any and all objections to the exercise of jurisdiction over you by these courts.

23. Waiver and Severability

No waiver by Centro Ararat any term or condition set forth in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Likewise, any failure by Centro Ararat enforce a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

If any provision of these Terms of Use is held by a court of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent necessary so that the remaining provisions of these Terms of Use remain in full force and effect.

24. Full Agreement

These Terms of Use and our Privacy Policy constitute the entire agreement between the parties with respect to the Website.
